PhotoCrew.co.uk — Terms and Conditions

These Terms and Conditions (“Terms”) govern access to and use of photocrew.co.uk and any related pages, profiles, listings, directories, dashboards, forms, communications tools, messaging features, review features, account areas, free plans, paid plans, subscriptions, credits, add-ons, promotional tools, search tools, applications, integrations and other services operated under the trading name PhotoCrew.co.uk (together, the “Platform”).

PhotoCrew.co.uk is operated as a sole trader business under the trading name PhotoCrew.co.uk (“PhotoCrew”, “we”, “us” or “our”). PhotoCrew is not currently VAT registered. If that position changes, applicable taxes may be charged in accordance with law and the information shown at the time of purchase.

These Terms are intended to protect PhotoCrew, its operator, administrators, personnel, contractors, suppliers, licensors, payment providers, hosting providers and other service providers to the fullest extent permitted by law. Nothing in these Terms excludes or limits any liability, statutory right, remedy or legal obligation that cannot lawfully be excluded or limited.

By accessing the Platform, creating an Account, publishing content, contacting another user, applying to an opportunity, purchasing a Paid Feature or otherwise using any part of the Platform, you confirm that you have read, understood and agree to these Terms. If you do not agree, you must not use the Platform.

Contents and location of key information
These Terms contain 80 sections and 12 schedules. Key provisions include: Platform role and User risk (sections 4, 13 and 50); User Content and intellectual property (sections 8–10 and 25–26); gigs, jobs and recruitment (sections 12 and 59); reviews (section 14 and Schedule 2); plans, payments and cancellation (sections 17–19 and Schedules 4 and 8); safety and moderation (sections 21–23, 57 and 76); liability and indemnity (sections 32–36 and Schedule 11); search and ranking (section 16 and Schedule 3); and operator and service details (section 66).

1. Important summary
This summary is provided for convenience only and does not replace the full Terms.

PhotoCrew is a specialist online platform, directory, discovery, visibility, communication and connection service for people and businesses involved in photography, video, content creation, creative services and production.
PhotoCrew provides infrastructure and tools. Unless expressly stated in a separate written agreement, PhotoCrew is not a party to any project, booking, gig, job, employment relationship, freelance engagement, collaboration, contract, payment, deposit, delivery, cancellation, dispute or other arrangement between users.
Users deal with one another at their own commercial, professional and personal risk.
PhotoCrew does not guarantee the identity, honesty, authority, qualifications, experience, licensing, insurance, right to work, tax status, financial position, availability, conduct, suitability or reliability of any user.
PhotoCrew does not guarantee the authenticity, ownership, accuracy, completeness, legality, accessibility, safety or quality of any profile, portfolio, image, video, service, listing, review, rating, message, application, offer or other user-submitted material.
Users must conduct their own checks, obtain appropriate written agreements, verify identity and credentials, agree payment and delivery terms, assess health and safety risks, obtain insurance and professional advice where appropriate, and decide independently whether to proceed.
Paid Plans, Boosts, Featured placements and other promotional tools do not guarantee ranking, visibility, views, enquiries, applications, bookings, work, revenue or any commercial result.
PhotoCrew may moderate, restrict, suspend, remove, re-rank or disable content or Accounts where reasonably considered necessary for safety, legality, integrity, technical, contractual, operational or reputational reasons, subject to applicable law.
Mandatory consumer rights and other rights that cannot lawfully be excluded remain unaffected.
2. Definitions
In these Terms:

Account means a registered PhotoCrew account.
Business User means a person or organisation using the Platform wholly or mainly for trade, business, craft or professional purposes.
Consumer means an individual acting wholly or mainly outside their trade, business, craft or profession.
Creator means an individual professional or aspiring professional using a Creator account.
Studio means a studio, agency, production company, creative business, team or other organisation using a Studio account.
Visitor means a user using a Visitor account or browsing without a public Creator or Studio profile.
Client means a person or organisation looking for, contacting or engaging creative talent or services.
User means any visitor, account holder, Creator, Studio, Client, applicant, reviewer or other person using the Platform.
User Content means anything uploaded, submitted, transmitted, published, displayed, generated or otherwise made available by a User, including text, names, biographies, photographs, videos, graphics, logos, documents, portfolio materials, links, prices, availability, services, listings, jobs, gigs, applications, messages, reviews, ratings, reports and responses.
Service Listing means a service offered or promoted by a Creator or Studio.
Gig means a generally short-term, one-off, project-based or temporary opportunity.
Job means a generally structured, regular, longer-term, fixed-term, freelance-contract, part-time or full-time opportunity.
Paid Plan means a paid subscription plan.
Paid Feature means any subscription, add-on, credit, Boost, Featured placement, additional listing, promotional feature or other paid functionality.
Boost means a paid or promotional visibility feature applied for a limited period.
Pro Badge means an indicator that the relevant Account has an active eligible paid plan. It is not a guarantee, endorsement or verification unless expressly stated otherwise.
Verification Badge means a badge linked to expressly described checks. It does not guarantee quality, honesty, safety or suitability.
Platform Content means content owned or licensed by PhotoCrew, excluding User Content.
Terms includes these Terms and any policy or schedule expressly incorporated into them.
3. Eligibility and age
The Platform is intended only for persons aged 18 or over.
By using the Platform, you represent and warrant that you are at least 18 and legally capable of entering into binding agreements.
A person using the Platform for an organisation confirms that they have authority to bind that organisation.
We may request information or evidence to confirm age, identity, authority, account ownership or eligibility.
We may restrict or terminate an Account where we reasonably suspect that a person is under 18, lacks authority, has supplied false information or is using the Platform unlawfully.
We do not guarantee that age or identity information supplied by Users is accurate.
Parents, guardians or other persons must not create an Account for a person under 18 or permit a person under 18 to use an Account contrary to these Terms.
4. Nature and role of PhotoCrew
PhotoCrew is a direct-connect creative marketplace, professional directory, visibility platform and communication service.
PhotoCrew may enable Users to create profiles, publish portfolios and services, search for talent and opportunities, publish gigs or jobs where eligible, submit applications, send enquiries and messages, display availability, publish or receive reviews, purchase plans or promotional features, and use analytics and account-management tools.
Unless expressly agreed otherwise in writing, PhotoCrew does not employ or engage Users; hire Users on behalf of Clients; supply workers; supervise projects; control working methods; determine prices, pay, contracts, deliverables or working conditions; hold project deposits as escrow; guarantee payment, attendance, completion, quality, safety or legal compliance; act as insurer, solicitor, accountant, tax adviser or professional adviser; act as agent or representative for either side; or become a party to User-to-User arrangements merely because the Platform was used.
Any agreement between Users is separate from these Terms and is entered into entirely between those Users.
PhotoCrew may provide templates, prompts, guidance, educational material, suggested questions or information. Such material is general only and is not legal, financial, tax, insurance, employment, health and safety or other professional advice.
The description of PhotoCrew as a marketplace does not mean PhotoCrew takes ownership of, supplies, performs, guarantees or accepts responsibility for services advertised by Users.
5. Accounts and registration
Registration information must be complete, current, accurate and not misleading.
You must not impersonate another person or business; create an Account using information you are not authorised to use; create multiple Accounts to evade limits, moderation or suspension; transfer, sell, rent or share an Account without permission; use automated means to create Accounts; conceal a material conflict of interest; or create an Account for unlawful, deceptive or abusive purposes.
You are responsible for maintaining the confidentiality of login details, using a secure password, protecting devices and email accounts, and all activity occurring through your Account except to the extent caused by PhotoCrew’s unlawful act or omission.
You must promptly notify us of suspected unauthorised access.
We may require password resets, additional authentication, identity checks, business checks or other security steps.
We may refuse registration or require additional information where reasonably necessary for safety, compliance, fraud prevention, technical integrity or enforcement of these Terms.
The existence of an Account does not mean that PhotoCrew has verified or approved the User.
Account types and plan features may change as the Platform develops. Current features and limits are those displayed on the Platform at the relevant time, subject to these Terms.
6. Account types
6.1 Visitor Accounts
Visitor Accounts are intended for Clients and other Users who wish to browse, search, contact talent, manage enquiries, publish eligible paid gigs or leave eligible reviews. Visitor Accounts do not ordinarily include a public creative portfolio or service profile.

6.2 Creator Accounts
Creator Accounts are intended for individual creative and production professionals. Creators may publish professional information, portfolio content, services and availability, and may apply to eligible gigs and jobs.

6.3 Studio Accounts
Studio Accounts are intended for studios, agencies, production companies, creative businesses and teams. Studios may publish business profiles, portfolios, services, team information, gigs and jobs, and may apply to eligible gigs.

6.4 Selecting and changing Account type
Users must select the Account type that most accurately reflects how they use the Platform.
Account conversion is not guaranteed.
We may refuse, delay or impose conditions on conversion where necessary to protect data integrity, subscriptions, listings, applications, reviews, billing records, moderation records or technical functionality.
We may correct an Account classification where the selected type is misleading or inconsistent with actual use.
7. Public profiles and publication risks
Creator and Studio profiles may be public and visible without login.
Public content may be accessed worldwide; indexed by search engines; cached; archived; linked to; copied manually; captured in screenshots or recordings; shared on social media; accessed by bots or automated systems; unlawfully scraped or republished; or included in external datasets despite restrictions.
Removing content from PhotoCrew does not guarantee removal from search engines, caches, archives, third-party websites, screenshots, downloads, messages, backups or copies outside our reasonable control.
Users must not publish information they require to remain confidential.
Users are responsible for deciding whether to make personal contact information, precise location information, availability or other details public.
PhotoCrew may provide privacy controls but does not guarantee that every control will prevent all external copying, indexing or disclosure.
We may change public-profile layouts, metadata, search presentation, snippets, thumbnails or display formats without preserving every previous presentation.
8. User warranties and responsibilities
Each User represents, warrants and undertakes that:

information supplied is accurate and not misleading;
they have the legal right and authority to publish all User Content;
User Content does not infringe copyright, trade marks, privacy, confidentiality, data protection, publicity, contractual, moral or other rights;
any person shown or identified has given any consent required by law or contract;
they have obtained any location, property, model, performer, music, stock, font, artwork or other releases and licences required;
claims about qualifications, awards, clients, experience, reviews, insurance, memberships and credentials are truthful and supportable;
prices and commercial statements are not misleading;
listings comply with employment, equality, consumer, advertising, tax, immigration, health and safety and other applicable law;
they will not use another User’s data except for a legitimate purpose connected with the relevant enquiry, opportunity or relationship;
they will not misuse contact details, send unlawful marketing, harass Users or add Users to mailing lists without a lawful basis;
they will comply with their own obligations as an independent data controller where applicable;
they will maintain appropriate professional, public liability, equipment, employer’s liability or other insurance where reasonably required;
they will comply with tax, VAT, licensing, immigration, right-to-work and business-registration obligations applicable to them;
they will perform any agreed service lawfully, safely and professionally;
they will not rely solely on PhotoCrew to conduct due diligence;
they will promptly correct inaccurate information and remove content they no longer have the right to publish.
These warranties are continuing and apply for as long as the relevant content or activity remains connected with the Platform.

9. User Content licence
You retain ownership of rights you hold in User Content.
By submitting User Content, you grant PhotoCrew a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence, for the period the content is available on the Platform and for a reasonable technical, evidential and backup period afterwards, to host, store, reproduce, back up, technically process, resize, crop, compress, convert, transcode, optimise, publish, display, communicate, distribute, create thumbnails and previews, index, categorise, make searchable, secure, moderate, test, improve and promote the Platform, and permit service providers to carry out those activities on our behalf.
The licence does not transfer ownership to PhotoCrew.
PhotoCrew is not obliged to use, preserve, promote or continue displaying User Content.
We may retain limited copies where necessary for legal claims, moderation, fraud prevention, security, audit, backup or compliance.
You waive, to the extent legally possible, any right to object to technical changes reasonably required to display the content, but no waiver transfers authorship or ownership.
You must not submit content subject to licence terms that conflict with this licence.
If you upload content on behalf of another person or organisation, you confirm that you are authorised to grant this licence.
10. Portfolio, intellectual property and releases
PhotoCrew does not verify portfolio ownership.
Users must be able to demonstrate rights on request.
Being the photographer, editor or participant does not always mean the User owns every right required for publication.
Users must consider copyright ownership, employer or client ownership, commissioned-work terms, usage licences, confidentiality clauses, non-disclosure agreements, model and performer releases, property releases, music and sound-recording rights, trade marks and branded materials, rights in artwork, design, fashion and architecture, privacy and data-protection obligations, and restrictions involving children or vulnerable persons.
PhotoCrew may remove content following a complaint or risk assessment without deciding final ownership.
Removal or continued display does not constitute a legal determination.
Users indemnify PhotoCrew as set out in these Terms for claims arising from content they were not entitled to publish, subject to the rules applicable to Consumers.
11. Messaging, enquiries and communications
Messaging and contact features are provided as communication tools only.
PhotoCrew does not guarantee delivery, receipt, response, identity of the sender, accuracy, confidentiality after receipt, continued storage, or freedom from spam, phishing, malware or fraud.
Users must keep their own records of important communications and agreements.
PhotoCrew may use automated or manual systems to detect spam, fraud, abuse, illegal content, harmful links, prohibited contact information or suspicious patterns.
We may delay, block, limit, scan, retain or disclose communications where reasonably necessary for security, moderation, legal compliance, enforcement or protection of Users.
Private messaging must not be treated as a secure channel for highly sensitive, financial, medical, identity or confidential information unless expressly supported.
Users must not harass, threaten or abuse others; send unsolicited bulk messages or unlawful direct marketing; request unnecessary identity or financial documents; solicit payment through suspicious methods; distribute malware or deceptive links; or pressure Users to move immediately to untraceable channels for fraudulent purposes.
PhotoCrew is not responsible for communications or conduct taking place outside the Platform.
12. Services, gigs, jobs and applications
12.1 Service Listings
A Service Listing is an advertisement or presentation by the relevant User.
PhotoCrew does not supply the advertised service.
The publishing User is responsible for accuracy, availability, pricing, taxes, qualifications, safety, deliverables, licences and compliance.
A listing does not create an obligation on PhotoCrew or guarantee acceptance by a Client.
12.2 Gigs
Gigs are generally intended for short-term, temporary, one-off or project-based opportunities.
The description “gig” does not determine legal employment status.
Users must independently determine whether the arrangement is employment, worker status, self-employment, agency work or another legal relationship.
12.3 Jobs
Jobs are generally intended for structured, regular, fixed-term, part-time, full-time or longer-term opportunities.
Publishers are responsible for lawful job advertising, equality, pay, right-to-work checks, worker status, employment documentation and recruitment compliance.
PhotoCrew does not guarantee that a listing is genuine, current, lawful or available.
12.4 Applications
An application does not create a contract, entitlement, interview, response or obligation.
Applicants are responsible for the accuracy of application information.
Publishers are responsible for handling application data lawfully.
PhotoCrew may limit applications, introduce eligibility criteria or prevent application where required by Account type, plan, geography, law, moderation or technical rules.
12.5 Recruitment and work-finding position
Unless expressly stated otherwise, PhotoCrew provides publication, search, discovery and communication tools rather than selecting, engaging, supervising, paying or supplying workers.
No label in these Terms determines PhotoCrew’s regulatory status if applicable law provides otherwise.
We may introduce additional checks, disclosures, processes or restrictions where required by employment-agency, recruitment, labour-market or other law.
Users must not rely on PhotoCrew’s general platform description as legal advice about employment or worker status.
13. User-to-User agreements and due diligence
Users enter agreements entirely at their own risk.
Before proceeding, Users should consider verifying identity and business registration; checking references, reviews, qualifications, memberships, right to work, insurance, equipment and backup arrangements; agreeing scope, deliverables, deadlines, fees, expenses, deposits, payment dates, cancellation, postponement, force majeure, copyright, usage rights, confidentiality, data protection, health and safety and dispute procedures; using a written contract; and obtaining independent professional advice where appropriate.
PhotoCrew does not perform these checks merely because a User appears on the Platform.
Users must decide independently whether another User is suitable.
To the fullest extent permitted by law, PhotoCrew is not responsible for false identity, misrepresentation, fraud, theft, non-payment, chargebacks, non-attendance, cancellation, late delivery, poor quality, damaged equipment, injury, unsafe locations, harassment, discrimination, intellectual-property disputes, confidentiality breaches, tax consequences, employment-status disputes or any other consequence of User-to-User dealings.
14. Reviews and ratings
Reviews must reflect a genuine experience or interaction.
Users must not submit fake reviews; review themselves; arrange coordinated reviews; use connected or duplicate Accounts; buy or sell reviews; condition a benefit on a positive review without lawful disclosure; threaten a negative review to obtain money or an improper benefit; conceal a material incentive; make defamatory, discriminatory, abusive, irrelevant or knowingly false allegations; or manipulate ratings or review order.
PhotoCrew may request evidence of an interaction or experience.
We may use automated and manual systems to detect suspicious reviews.
We may reject, delay, label, restrict, remove or restore reviews.
We do not guarantee that every review is genuine, accurate, complete, fair or representative.
A review may remain visible during a dispute unless removal is reasonably required.
PhotoCrew is not a court and does not determine every underlying factual dispute.
Users may report reviews and, where available, appeal moderation decisions.
Negative reviews will not be removed merely because they are negative.
We may disclose review information where required by law or reasonably necessary to investigate fraud, threats, unlawful conduct or legal claims.
Star ratings are summaries and must not be treated as a guarantee.
Publishers of reviews remain responsible for their statements.
15. Badges, verification and status indicators
A Pro Badge indicates an eligible paid status only.
A Pro Badge does not mean that PhotoCrew has verified identity, checked qualifications, inspected work, verified insurance, endorsed the User, guaranteed performance, approved prices or guaranteed honesty or safety.
A Verification Badge applies only to the checks expressly described for that badge.
Verification may be limited, time-specific, document-specific or provider-dependent.
Documents may be forged, outdated, withdrawn or inaccurate.
Verification does not transfer responsibility from the User or remove the need for Client checks.
We may suspend or remove a badge if eligibility ends, information changes, payment fails, evidence expires or concerns arise.
Badges may change in design, terminology, availability or requirements.
16. Search, ranking, recommendations, Featured placements and Boosts
Search and ranking may use multiple parameters, including relevance to a search, category and service match, location and distance, profile completeness, portfolio activity, recency, availability, reviews and ratings, verification, account status, response or engagement signals, content quality, Paid Plan status, Featured or Boost status, fraud, safety or moderation signals, technical factors and randomisation.
The relative importance of parameters may vary by page, device, query, location, inventory, experiment, fraud risk and Platform design.
Paid features may influence visibility where clearly described, but do not guarantee a fixed position.
PhotoCrew may test, rotate, diversify, personalise or randomise results.
Rankings may change at any time.
No User has a right to a permanent rank, impression count, homepage position or level of traffic.
We may reduce visibility or exclude content for quality, duplication, inactivity, safety, compliance, technical, geographic or integrity reasons.
Analytics and rank indicators are estimates and may be delayed, incomplete or affected by consent choices, bots, caching, privacy tools and technical limitations.
PhotoCrew does not guarantee that a Boost, Featured placement or Pro plan will produce views, enquiries, applications, bookings, work, income or return on investment.
Business Users may contact us for information or to complain about ranking, restriction, suspension or termination.
We may provide a statement of reasons where required by applicable platform-to-business or online-safety law, subject to legal exceptions including security, fraud, abuse prevention, legal restrictions and repeated breaches.
17. Paid Plans and Paid Features
The features, limits, duration and price shown at purchase form part of the relevant order.
Unless stated otherwise, payment is due in advance; subscriptions renew automatically at the stated interval; cancellation stops future renewal but does not by itself create a refund for the current period; Paid Features may have expiry dates; unused credits, listings or benefits may expire; deleting content does not necessarily restore an included slot; downgrading may reduce display, limits, access or visibility; content exceeding a lower plan limit may be hidden, restricted or unavailable without being immediately deleted; non-payment may cause suspension or downgrade; prices may change for future billing periods after appropriate notice; eligibility rules may apply; and a Paid Feature is licensed, not sold.
Promotional features do not guarantee results.
We may correct obvious pricing or description errors before or after an order, subject to law.
We may reject or refund an order that cannot be fulfilled.
Payment-provider approval is not guaranteed.
Taxes, banking charges, currency-conversion charges and third-party fees may apply.
Users must keep billing information current.
If a payment is disputed, reversed or charged back, we may suspend the related feature while investigating.
Business Users purchase Paid Features for business purposes unless expressly purchasing as a Consumer.
Nothing in this section limits mandatory consumer rights.
18. Consumer cancellation rights
A Consumer may have a statutory right to cancel certain distance contracts within 14 days after the contract is made.
The Platform or checkout may ask a Consumer to expressly request that a service or Paid Feature starts during the cancellation period.
If a Consumer requests immediate performance and later cancels during the statutory period, PhotoCrew may deduct or charge a proportionate amount for service supplied before cancellation where law permits.
Where a digital service or feature has been fully performed, cancellation rights may be affected only where the legal requirements have been satisfied.
A Consumer can communicate a cancellation decision by a clear statement sent to hello@photocrew.co.uk or through an available cancellation tool.
Subscription cancellation and statutory contract cancellation are different: subscription cancellation prevents future renewal; statutory cancellation may create rights relating to the current contract.
Refunds will be provided where required by law.
No term excludes a Consumer’s right to a remedy where PhotoCrew’s own service is not supplied with reasonable care and skill or otherwise fails to comply with mandatory law.
Add-ons, credits or promotional features that begin immediately may be partly or fully consumed. The legal effect depends on the type of supply and the Consumer’s express choices at purchase.
Users should retain purchase confirmations and cancellation communications.
19. Payments and third-party processors
Payments may be processed by third-party providers such as Stripe or another provider displayed at checkout.
PhotoCrew may not receive or store full card details.
Payment providers may apply their own terms, privacy notices, fraud rules, authentication, reserves, holds, refusals, chargeback procedures and account restrictions.
PhotoCrew is not responsible for a provider’s independent decision, outage, security control, delay or refusal except to the extent PhotoCrew is legally responsible.
Users must not use stolen payment details, evade fees, abuse chargebacks, misrepresent an unauthorised transaction, manipulate promotions or interfere with payment systems.
We may share relevant transaction, account, device and risk information with payment, fraud-prevention, legal and professional service providers.
Project payments between Users are separate from payments made to PhotoCrew.
PhotoCrew does not guarantee recovery of money paid directly from one User to another.
Users should use payment methods and contracts appropriate to their risk.
20. Availability calendar, analytics and performance information
Availability information is supplied by Users and may be incomplete, outdated or inaccurate.
“Available” does not create a booking or obligation.
Users must confirm dates directly.
Analytics may be estimates and may exclude traffic because of cookie rejection, browser privacy tools, ad blockers, bots, caching, network errors, incomplete logging, duplicate filtering, delayed processing, user deletion or technical changes.
PhotoCrew does not warrant that analytics represent unique people, commercial value, actual enquiries or confirmed bookings.
Performance summaries, recommendations and insights are informational only.
Users must not make financial or business decisions solely on Platform analytics.
21. Prohibited conduct
Users must not break the law or encourage unlawful conduct; impersonate another person or business; publish fraudulent, deceptive or materially misleading content; infringe intellectual-property, privacy, confidentiality or data-protection rights; upload intimate, sexual, exploitative or illegal content; upload content involving children contrary to law or without appropriate rights and safeguards; threaten, harass, stalk, discriminate against or abuse others; facilitate fraud, money laundering, trafficking, exploitation or illegal work; publish discriminatory job criteria unless lawfully justified; send spam or unlawful marketing; distribute malware, phishing links or malicious code; scrape, crawl, harvest, copy or extract Platform data without permission; create datasets for facial recognition, surveillance, AI training or machine-learning training without permission and a lawful basis; reverse engineer or interfere with the Platform; bypass access, plan, listing, rate or security limits; manipulate search, reviews, analytics, clicks or engagement; create duplicate or fake Accounts; use contact information for unrelated solicitation; disclose another person’s sensitive information without lawful justification; use the Platform to arrange unlawful, unsafe or exploitative services; falsely claim affiliation, verification or endorsement; evade suspension or moderation; use automated systems without permission; or assist another person to do any of these things.

22. Safety, illegal content and reporting
Users may report content, Accounts, messages, reviews, gigs, jobs or conduct to hello@photocrew.co.uk or through an available reporting tool.
Reports should include the relevant URL or identifier, a clear explanation and supporting evidence where available.
PhotoCrew may prioritise reports involving threats or violence, child sexual exploitation or abuse, terrorism, fraud, intimate-image abuse, stalking or harassment, trafficking or exploitation, unlawful discrimination, intellectual-property infringement or urgent safety concerns.
We may investigate, request information, preserve records, limit visibility, disable content, suspend Accounts, prevent contact, report matters to authorities or take no action where a report is unsupported or outside scope.
We do not guarantee immediate review, a particular outcome or prevention of all harmful conduct.
Users facing immediate danger should contact the appropriate emergency or law-enforcement service rather than rely solely on PhotoCrew.
False, malicious or abusive reports may result in action against the reporter.
We may maintain risk assessments, moderation processes, complaint procedures and records as required by applicable online-safety law.
Where required, Users may complain about certain content or moderation decisions and receive an outcome subject to lawful restrictions.
PhotoCrew may take urgent action without prior notice where necessary for safety, fraud prevention, legal compliance or system integrity.
23. Moderation, restriction, suspension and termination
PhotoCrew may review User Content but is not obliged to pre-screen every item.
We may remove, restrict, label, reclassify, de-rank, block, suspend or terminate where we reasonably believe these Terms have been breached; content may be illegal or infringing; an Account creates a safety or fraud risk; information is misleading; payment has failed; a plan or feature has expired; activity threatens technical integrity; action is required by law, court, regulator, payment provider, insurer or service provider; action protects Users or PhotoCrew; the Account is inactive, duplicative or abandoned; or continued use creates disproportionate legal, operational or reputational risk.
We may take temporary action while investigating.
Notice may be given where reasonably practicable and legally appropriate.
We may withhold detailed reasons where disclosure would compromise security, facilitate evasion, expose another person’s confidential information, prejudice an investigation, breach law or increase risk.
Business Users may submit a complaint or appeal to hello@photocrew.co.uk.
Reinstatement is not guaranteed.
Termination does not erase accrued rights, payment obligations, records required by law or provisions intended to survive.
Where PhotoCrew ends a paid service without User breach, any refund will be determined by the purchased service, unused period, consumer law and circumstances.
Where termination results from breach, fraud, chargeback, illegality or abuse, refunds may be refused to the extent permitted by law.
24. Account deletion and consequences
Users may request Account deletion through available tools or by email.
Deletion may remove public access, end plan access, remove listings, affect messages, applications, reviews and records, but it may not cancel a subscription unless the subscription is separately cancelled.
We may retain information required for legal obligations, tax and accounting, fraud prevention, safety, complaints, dispute resolution, payment records, enforcement and backups.
Reviews or records may be retained in anonymised, restricted or evidential form where lawful.
Public removal does not guarantee deletion of third-party copies.
Users should export or save information they need before deletion.
25. Intellectual property in the Platform
Platform Content, software, design, branding, logos, databases, layout, code, text, graphics and functionality are owned by or licensed to PhotoCrew.
Users receive a limited, revocable, non-exclusive, non-transferable right to use the Platform in accordance with these Terms.
Users must not copy or reproduce substantial parts, create a competing database through extraction, use branding without permission, reverse engineer, remove notices, frame or mirror the Platform, resell access, use Platform Content for AI training or exploit the Platform beyond permitted use.
Search-engine indexing that complies with technical instructions and law is not prohibited unless blocked.
All rights not expressly granted are reserved.
26. Copyright, privacy and takedown notices
A rights complaint should be sent to hello@photocrew.co.uk.
It should include complainant name and contact details, identification of the protected work or right, identification and exact location of the complained-of content, explanation of the alleged infringement, evidence of ownership or authority, a good-faith statement and confirmation of accuracy.
We may request further information.
We may remove or restrict content without admitting liability.
We may notify the publishing User and permit a response.
PhotoCrew does not adjudicate final ownership.
False, reckless, abusive or bad-faith notices may lead to suspension or legal consequences.
We may restore content where a complaint is withdrawn, unsupported or resolved.
Users remain responsible for seeking independent legal remedies where necessary.
27. Third-party services, integrations and links
The Platform may depend on hosting, CDN, security, payment, email, analytics, map, video, social, storage, search, verification, anti-spam, support and other third-party services.
Third-party services may have separate terms and privacy notices.
PhotoCrew does not control every third-party system.
Integrations may change, fail, become unavailable, alter functionality, impose restrictions, process data outside the UK or require separate consent.
External links do not imply endorsement.
Users access external services at their own risk and should review their terms.
PhotoCrew is not responsible for third-party content, policies, security, availability or acts except to the extent legally responsible.
28. Artificial intelligence and automated tools
PhotoCrew may use automated or AI-assisted tools for search, categorisation, recommendations, moderation, fraud detection, spam detection, support, analytics, content formatting and technical operations.
Automated outputs may be inaccurate, incomplete, biased or unavailable.
PhotoCrew does not guarantee that automated classifications, recommendations or risk signals are correct.
Material enforcement decisions may include human review where required by law or reasonably appropriate.
Users must not rely on automated output as professional advice.
Users remain responsible for content they publish using AI tools.
Users must ensure AI-generated content does not infringe rights, mislead others or falsely represent real work.
PhotoCrew may restrict synthetic, manipulated or deceptive content.
Automated processing is further explained in the Privacy Notice.
29. Beta, experimental and changing features
Some features may be described as beta, preview, experimental, test or early access.
Such features may be incomplete, inaccurate, unstable or withdrawn without notice.
Data or settings may be reset.
Users should not rely on experimental features for critical operations.
Feedback may be used to improve the Platform without payment or obligation.
We may test different layouts, prices, ranking methods, limits and features with different Users where lawful.
30. Availability, maintenance and data loss
PhotoCrew does not guarantee uninterrupted, permanent, secure or error-free access.
Access may be affected by maintenance, hosting failure, network failure, cyberattack, software defects, plugin conflict, third-party outage, legal restriction, capacity limits, updates or force majeure.
We may suspend all or part of the Platform.
Users must retain independent copies of important content, contracts, messages and portfolio files.
PhotoCrew is not a backup or archival service.
We will use reasonable care in supplying our own service but cannot promise that no data will ever be lost, corrupted or delayed.
Liability for data loss is subject to the limitation provisions below and mandatory law.
31. Security
Users acknowledge that no online system is completely secure.
PhotoCrew may use proportionate technical and organisational measures, but does not warrant immunity from every attack.
Users must protect passwords, use secure devices and networks, verify payment requests, be cautious of links and attachments, report suspicious activity and avoid sharing sensitive data unnecessarily.
PhotoCrew may restrict actions or require verification for security.
Security controls may create false positives or delay activity.
Users must not test, scan or exploit vulnerabilities without written permission.
A security concern should be reported to hello@photocrew.co.uk.
Nothing in these Terms excludes obligations arising under applicable data-protection or cybersecurity law.
32. No warranties
To the fullest extent permitted by law, the Platform is provided on an “as available” and “as is” basis.

PhotoCrew does not warrant or represent that the Platform will always be available; every feature will work on every browser, device or assistive technology; content is accurate, complete, current, lawful, accessible or safe; Users are genuine, honest, qualified, insured, available or suitable; a listing will receive views or applications; an application will receive a response; a Paid Feature will produce a result; analytics are complete or commercially reliable; search results are exhaustive; security controls will prevent every incident; defects will be corrected immediately; third-party systems will remain available; content will never be copied or scraped; or use of the Platform will meet every User’s needs.

Nothing in this section excludes a warranty or term that cannot lawfully be excluded.

33. Limitation of liability — general
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence where liability cannot be excluded; fraud or fraudulent misrepresentation; deliberate unlawful conduct where exclusion is prohibited; breach of mandatory consumer rights; or any other liability that law does not permit us to exclude or limit.
Subject to paragraph 1 and to the fullest extent permitted by law, PhotoCrew is not liable for loss arising from conduct or content of Users, User-to-User agreements, identity fraud or misrepresentation, non-payment or chargebacks between Users, missed work, bookings, messages or opportunities, portfolio or rights disputes, employment or tax disputes, injury or damage occurring during a User project, third-party services, external websites, unlawful scraping, search-engine indexing, deletion of external copies, cookie choices, unsupported devices or events beyond reasonable control.
Users remain responsible for taking reasonable steps to avoid and mitigate loss.
34. Liability to Business Users
Subject to section 33:

PhotoCrew is not liable to a Business User for loss of profit, revenue, business, contracts, opportunity, anticipated savings, goodwill or reputation; indirect or consequential loss; loss arising from reliance on analytics, ranking or promotional results; or loss of data where the Business User failed to keep reasonable backups.
PhotoCrew’s aggregate liability arising out of or connected with the Platform in any rolling 12-month period shall not exceed the greater of the total amount paid by that Business User to PhotoCrew during the preceding 12 months for the service giving rise to the claim or £100.
The cap does not apply to liability that cannot lawfully be limited.
Each limitation is separate and applies whether the claim is in contract, tort, negligence, misrepresentation, restitution, breach of statutory duty or otherwise.
Business Users acknowledge that Paid Feature prices reflect the allocation of risk in these Terms.
35. Liability to Consumers
PhotoCrew is responsible for foreseeable loss caused by its breach of these Terms or failure to use reasonable care and skill where required by law.
PhotoCrew is not responsible for loss that was not foreseeable, was caused by another User, resulted from the Consumer’s failure to take reasonable precautions, was business loss arising from use primarily for business purposes, or is excluded or limited lawfully elsewhere in these Terms.
Nothing limits mandatory rights or remedies under consumer law.
Consumers should contact hello@photocrew.co.uk promptly so that PhotoCrew has a reasonable opportunity to investigate and remedy a problem.
36. Business User indemnity
To the fullest extent permitted by law, each Business User shall indemnify and keep indemnified PhotoCrew and its operator against losses, liabilities, claims, damages, judgments, settlements, penalties, reasonable legal costs and professional expenses arising from or connected with the Business User’s User Content; infringement of third-party rights; unlawful listings or employment practices; breach of data-protection obligations; services supplied or promised by the Business User; injury, damage, loss or non-performance connected with the Business User’s project; tax, employment-status, immigration, insurance or licensing failures; misleading statements; fake or manipulated reviews; breach of these Terms; or a claim by another User or third party relating to the Business User’s conduct.

This indemnity does not apply to the extent a loss was caused by PhotoCrew’s own unlawful act and cannot lawfully be shifted.

37. Force majeure
PhotoCrew is not liable for delay or failure caused by events beyond reasonable control, including natural disaster, fire, flood, epidemic, pandemic, war, terrorism, civil disorder, industrial action, utility failure, network failure, cyberattack, government action, legal change, hosting failure, payment-provider failure, transport disruption, supplier failure or widespread internet outage.

38. Changes to the Platform and Terms
We may update the Platform and these Terms for legal or regulatory changes, security, technical changes, new or discontinued features, pricing or business-model changes, clarification, fraud prevention or user protection.
Material changes may be notified through the Platform, Account, email or another reasonable method.
Business Users will receive advance notice where required by applicable platform-to-business law, subject to lawful exceptions.
Changes may take immediate effect where necessary for law, urgent security, fraud prevention or to address danger.
Continued use after the effective date constitutes acceptance where legally valid.
If a User does not accept a material change, the User may stop using the Platform and cancel future renewal.
Earlier versions may be retained for evidence.
39. Complaints and appeals
General complaints may be sent to hello@photocrew.co.uk.
Include the Account email or identifier, relevant URL, clear description, dates, evidence and requested outcome.
We may request further information.
We aim to investigate proportionately but do not guarantee a particular result.
Separate procedures may apply to data-protection complaints, content reports, copyright complaints, review disputes, payment disputes and moderation appeals.
We may combine related complaints.
Abusive, repetitive or bad-faith complaints may be restricted where lawful.
Nothing prevents a person from exercising a statutory right or contacting a competent regulator, court or authority.
40. Data protection
Personal data is handled as described in the Privacy Policy.
The Cookie Policy explains cookies and similar technologies.
Users who receive personal data from another User may become independent controllers and must comply with law.
Users must not use Platform data for unrelated marketing, profiling, sale, scraping, surveillance or dataset creation.
Data-protection complaints may be submitted to hello@photocrew.co.uk.
PhotoCrew will acknowledge data-protection complaints within 30 days and respond without undue delay as required by applicable law.
41. Notices
Notices to PhotoCrew must be sent to hello@photocrew.co.uk, unless a specific procedure states otherwise.
Notices to a User may be sent to the registered email, dashboard, Platform notification or last contact information supplied.
Users must keep contact details current.
Email delivery is not guaranteed; Users should check spam folders and dashboard notices.
A notice is treated as received according to applicable law and evidence of transmission.
42. Assignment and subcontracting
Users may not assign or transfer their Account or rights without written consent.
PhotoCrew may assign, transfer, subcontract or novate rights and obligations as part of a business transfer, restructuring, supplier arrangement or sale, provided mandatory rights are not reduced unlawfully.
Service providers may perform functions on PhotoCrew’s behalf.
43. No partnership, agency or employment
Nothing in these Terms creates a partnership, joint venture, fiduciary relationship, employment relationship or agency between PhotoCrew and any User, or between Users, except where a separate written agreement expressly states otherwise or law determines otherwise.

44. Waiver
Failure or delay in enforcing a right is not a waiver. A waiver is effective only if clearly communicated and applies only to the specific circumstances.

45. Severability
If any provision is unlawful, invalid or unenforceable, it shall be interpreted or reduced to the minimum extent necessary to make it enforceable where possible. The remaining provisions continue in effect.

46. Entire agreement
These Terms and incorporated policies form the agreement about use of the Platform.
They do not replace a separate User-to-User contract.
Business Users acknowledge that they have not relied on statements not included in the applicable written agreement, except that nothing excludes liability for fraud.
Mandatory pre-contract information provided to Consumers remains part of the contract where law requires.
47. Third-party rights
A person who is not a party to these Terms has no right to enforce them, except that PhotoCrew’s operator, administrators, contractors and service providers may rely on provisions expressly intended to protect them, subject to applicable law.

48. Governing law and jurisdiction
These Terms are governed by the law of England and Wales.
Courts of England and Wales have jurisdiction, subject to mandatory rights that permit a Consumer to bring proceedings in another part of the United Kingdom or another competent jurisdiction.
Business Users submit to the exclusive jurisdiction of the courts of England and Wales, except where PhotoCrew elects another competent forum for urgent protective relief.
Nothing prevents PhotoCrew from seeking injunctive or protective relief where rights, security or confidential information are threatened.
49. Survival
Provisions concerning intellectual property, User Content licences, payment, liability, indemnity, records, privacy, enforcement, disputes and any term intended by nature to survive remain effective after suspension, termination or deletion.

50. Additional interpretation and allocation of risk
These Terms are intended to allocate responsibility to the person best able to control the relevant risk. PhotoCrew controls the operation of its own Platform subject to technical, legal and third-party limitations. Users control the information they provide, the people they contact, the checks they carry out, the agreements they enter into, the work they perform, the payments they make or receive, and the conduct occurring outside the Platform.
A provision that states that PhotoCrew does not verify, guarantee, supervise, insure, endorse or accept responsibility for a matter must be interpreted as broadly as the law permits, but never as excluding a duty that the law makes mandatory.
References to acting “at your own risk”, “entirely at your own risk” or “at the User’s sole risk” mean that the User must make an independent decision, undertake appropriate checks, obtain advice where needed and accept the ordinary commercial, professional, personal, technical and practical risks of dealing with third parties. Such wording does not exclude liability that cannot lawfully be excluded.
Examples in these Terms are illustrative and do not restrict the general meaning of a provision.
The words “including”, “includes”, “such as”, “for example” and similar expressions mean “including without limitation”.
A singular word includes the plural and vice versa. A reference to a person includes an individual, sole trader, partnership, company, body corporate, unincorporated association, charity, public authority and any other legal or commercial organisation.
Headings, summaries, tables and schedules are for convenience and do not limit the operative provisions.
Where a right is stated to arise “where permitted by law”, “to the fullest extent permitted by law”, “where reasonably necessary” or with similar wording, it must be interpreted according to the law applicable to the relevant User and transaction.
If separate terms apply to a particular feature, those separate terms prevail only to the extent of a direct conflict and only for that feature.
Policies linked from these Terms form part of the contractual and operational framework where expressly incorporated, but a privacy notice is primarily informational and does not create consent where another lawful basis is required.
51. Consumer and Business User classification
Different legal rules may apply depending on whether a User is a Consumer or Business User.
A Creator, Studio, agency, production company, professional, freelancer or person purchasing a feature for commercial purposes will normally be treated as a Business User.
A Visitor may be a Consumer or Business User depending on the purpose of use.
A person must not falsely claim Consumer status to obtain rights intended only for Consumers, or falsely claim Business User status to evade mandatory consumer protection.
PhotoCrew may rely on information reasonably available at registration, checkout, invoicing and use to determine the apparent status of a User.
A User must notify PhotoCrew if their status materially changes.
If a court or authority determines that a User is a Consumer despite being treated as a Business User, mandatory Consumer rights apply and the remaining Business User terms continue only to the extent lawful.
If a User acts partly for business and partly for private purposes, the statutory test applicable to the particular transaction determines status.
52. No fiduciary, advisory, representative or special relationship
PhotoCrew does not owe a fiduciary duty to a User merely because it hosts a profile, processes a subscription, displays a listing, supplies analytics, moderates content or facilitates communication.
PhotoCrew does not act as trustee, custodian, escrow agent, stakeholder, adviser, broker, negotiator, talent manager, booking agent, recruitment consultant, representative, partner, joint venturer, employer or employee unless expressly confirmed in a separate written agreement signed by PhotoCrew.
No User has authority to bind PhotoCrew, make commitments on its behalf, incur liability for it, represent that PhotoCrew approved a project, or use PhotoCrew branding in a manner suggesting sponsorship or agency.
PhotoCrew’s knowledge of an enquiry, message, application, booking discussion, payment or dispute does not create a duty to supervise or intervene.
The availability of reporting or support tools does not make PhotoCrew responsible for preventing every misuse or resolving every disagreement.
53. No exclusivity and no obligation to transact
PhotoCrew is non-exclusive. Users may use other platforms, advertise elsewhere and contract independently.
PhotoCrew is not obliged to accept, publish, promote or continue hosting any Account, profile, service, gig, job, application, review or other content.
No User is obliged to accept an enquiry, application, quote, proposal or offer solely because it was made through the Platform.
A displayed price, rate, availability entry or service description is not necessarily a binding offer unless the relevant User clearly makes it one under applicable law.
PhotoCrew does not guarantee that a User will remain available after contact.
A search result, recommendation, badge or listing position is not an instruction to transact.
54. Enhanced User due diligence obligations
Before contacting, hiring, paying, engaging, meeting, travelling with, granting access to, employing, contracting with or sharing confidential information with another User, the User should undertake all checks reasonably appropriate to the circumstances. Depending on the project, these may include:

confirming full legal identity;
confirming the identity and authority of the person communicating;
verifying the legal name, registration and status of a company or business;
checking whether a person is authorised to enter into a contract;
checking references and genuine examples of prior work;
checking qualifications, licences, memberships and awards directly with the issuer;
checking professional, public liability, employer’s liability, equipment and other relevant insurance;
checking right to work, immigration status or required permits where the User is legally responsible for doing so;
checking safeguarding, criminal-record or sector-specific requirements where legally appropriate;
confirming location, access, parking, travel, accommodation, venue permissions and working hours;
confirming the identity of all relevant crew, subcontractors and assistants;
confirming ownership, licensing and permitted use of equipment, software, music, stock assets and other materials;
agreeing scope, deliverables, file formats, editing, revisions, deadlines, approvals and acceptance criteria;
agreeing fees, currency, VAT, expenses, overtime, deposits, milestones and payment dates;
agreeing cancellation, postponement, rescheduling, weather, illness, equipment failure and force-majeure terms;
agreeing copyright ownership, licence duration, territory, media, exclusivity, moral rights, credits and portfolio use;
agreeing privacy, confidentiality, embargo and non-disclosure requirements;
agreeing model, performer, property, location and music releases;
carrying out an appropriate health and safety assessment;
obtaining independent legal, tax, insurance, employment or professional advice where necessary.
PhotoCrew does not undertake these checks for Users merely because it provides fields, badges, reviews, filters or messaging. Failure to carry out checks is at the relevant User’s risk.

55. Meetings, physical locations, travel and personal safety
PhotoCrew does not organise, supervise, inspect or control meetings, studios, homes, venues, sets, events, public places, travel, accommodation or physical working environments arranged between Users.
Users meet and attend locations entirely at their own risk and must make their own safety arrangements.
Users should tell a trusted person where they are going, verify the address, use appropriate transport, consider meeting in a public place where suitable, preserve communications, and avoid carrying unnecessary cash or valuables.
A User must not pressure another User to attend an unsafe, unlawful, undisclosed or materially different location.
Users are responsible for access permissions, licences, parking, congestion charges, permits, travel documents, accommodation, subsistence, equipment security and personal belongings.
PhotoCrew is not responsible for theft, loss, damage, assault, harassment, injury, illness, delay, missed transport, unsafe premises or any act occurring at a physical meeting or project, except to the extent liability cannot lawfully be excluded.
In an emergency, Users must contact emergency services or the relevant authority rather than rely on PhotoCrew support.
56. Health, safety, equipment and production risk
Users are solely responsible for complying with applicable health and safety law and for conducting appropriate risk assessments.
Risks may include electrical equipment, lighting, cables, trip hazards, drones, vehicles, heights, water, weather, crowds, children, animals, smoke, pyrotechnics, weapons, props, hazardous materials, manual handling, noise, fatigue, lone working and remote locations.
Users must use competent personnel and suitable equipment, follow manufacturer instructions, maintain equipment, use protective equipment and stop work where conditions are unsafe.
PhotoCrew does not inspect or certify equipment, premises, risk assessments, insurance, licences or working practices.
A portfolio image depicting a risky activity is not evidence that the activity was lawful or safe.
PhotoCrew is not responsible for personal injury, property damage, equipment failure, data loss or production interruption caused by a User or project participant, except where liability cannot lawfully be excluded.
Users must obtain specialist advice for drone operations, aviation, child performance, road closures, public events, stunts, underwater work and other regulated activities.
57. Safeguarding, children and vulnerable persons
Accounts and interactive use are restricted to persons aged 18 or over, but User Content or projects may involve children or vulnerable persons.
Users are responsible for all safeguarding, consent, supervision, licensing, chaperone, working-time, privacy and welfare obligations applicable to a project.
Users must not use PhotoCrew to groom, exploit, sexualise, traffic, coerce or endanger a child or vulnerable person.
Users must not request or publish unnecessary identifying information about a child.
Users must not upload exploitative, abusive, intimate or unlawful material involving a child.
PhotoCrew may remove material, preserve evidence, suspend Accounts and report concerns to relevant authorities without prior notice.
PhotoCrew does not guarantee that every User has undergone a criminal-record, safeguarding or background check.
A verification or paid badge does not constitute safeguarding clearance.
Persons responsible for a child or vulnerable person must independently verify all relevant people, locations and arrangements.
58. Equality, discrimination and lawful opportunity advertising
Users must comply with equality, anti-discrimination and employment law.
A job, gig, service request or casting requirement must not unlawfully discriminate on grounds protected by law.
A genuine occupational or artistic requirement must be stated accurately and used only where legally justified.
Users must not harass, victimise or discriminate against another person through listings, messages, reviews, selection, payment or project conduct.
PhotoCrew may remove content that appears discriminatory without making a final legal determination.
PhotoCrew is not responsible for a User’s independent selection or employment decision.
Users should obtain legal advice before relying on an exception to equality law.
59. Employment status, work-finding and recruitment regulation
Labels such as “Creator”, “freelancer”, “gig”, “contractor”, “self-employed”, “job” or “Studio” do not determine legal employment or tax status.
The true relationship may create employee, worker, self-employed, agency-worker, partnership or other status regardless of wording used by Users.
Users are responsible for determining status, tax treatment, minimum wage, working time, holiday pay, pension, payroll, right-to-work, employment documentation and other obligations.
PhotoCrew intends to provide publication, discovery, application and communication tools rather than to employ, supply, supervise or pay workers.
However, regulatory status is determined by law and actual operation, not merely by a disclaimer. PhotoCrew may introduce additional procedures, terms, records, identity checks, vacancy checks, hirer checks or restrictions to comply with employment-agency or work-finding legislation.
Users must cooperate with those procedures.
No User may charge an unlawful fee to a work-seeker, advertise a non-existent role, submit a person’s details without authority, or make an unlawful ancillary service compulsory.
PhotoCrew makes no promise that use of a listing label eliminates regulatory obligations.
60. Insurance
PhotoCrew does not provide insurance for Users, projects, equipment, travel, venues, public liability, professional indemnity, employer’s liability, cyber risk, cancellation or non-payment.
Users must decide what insurance is appropriate and verify policy scope, limits, exclusions, territory and validity.
A User’s statement that insurance exists is User Content and is not guaranteed by PhotoCrew.
PhotoCrew may request evidence but is not obliged to verify continuing cover.
Failure by a User to obtain adequate insurance does not transfer risk to PhotoCrew.
61. Taxes, VAT, accounting and reporting
Users are solely responsible for all income tax, Corporation Tax, VAT, National Insurance, PAYE, payroll, pension, withholding, invoicing, bookkeeping, reporting and registration obligations arising from their activities.
PhotoCrew does not determine whether a User is VAT registered, whether a price includes VAT, or whether a payment should be treated as employment income, business income, commission, reimbursement or another category.
Users must issue legally compliant invoices and retain records.
PhotoCrew may collect, retain or disclose information where required by tax, payment, anti-fraud or reporting law.
PhotoCrew is not responsible for penalties, interest, reassessments or loss of relief caused by a User’s tax treatment.
Nothing on the Platform constitutes tax advice.
62. Fraud, financial crime, sanctions and suspicious activity
Users must not use the Platform for fraud, theft, identity crime, money laundering, terrorist financing, sanctions evasion, tax evasion, bribery, corruption, trafficking or handling criminal property.
PhotoCrew may use automated and manual controls, request evidence, delay activity, suspend Accounts, preserve records and make disclosures where lawful.
PhotoCrew may refuse to explain a security decision where explanation could facilitate evasion, prejudice an investigation or breach law.
A payment approval by a provider does not mean the transaction or User is legitimate.
Users must verify unexpected payment instructions and must not send money using untraceable methods merely because another User requests it.
PhotoCrew is not a bank, payment institution, escrow service or financial adviser.
Users bear the risk of money paid directly to another User and must pursue recovery against that User or payment provider where appropriate.
63. User-to-User payments, deposits, refunds and chargebacks
Unless a feature expressly states otherwise, PhotoCrew does not receive, hold, protect, insure or guarantee project payments made between Users.
Users must agree who is paid, when, by what method, in what currency, and on what refund or cancellation terms.
PhotoCrew is not responsible for deposits, retainers, expenses, staged payments, cash payments, bank transfers, PayPal payments, cryptocurrency, chargebacks or payment disputes between Users.
A User should not assume that a payment is irreversible merely because funds appear available.
Users must maintain evidence of contracts, invoices, approvals, delivery and communication.
PhotoCrew may provide platform records where lawful and proportionate but is not obliged to act as witness, debt collector, adjudicator or mediator.
A dispute between Users does not create a right to a refund of fees paid to PhotoCrew for a separate Platform service unless law or the specific order terms provide otherwise.
64. Public contact details, privacy and unwanted communications
A User who publishes an email address, telephone number, website, social profile, location or other contact information accepts that it may be accessed, copied, indexed, shared, archived or misused by third parties despite Platform rules.
Users should use business contact details and avoid publishing sensitive personal information.
PhotoCrew may offer contact masking or messaging but does not guarantee anonymity.
PhotoCrew cannot prevent every spam message, scam, phishing attempt, scraped contact, unsolicited call or communication occurring outside the Platform.
Users must use blocking, filtering and reporting tools and must notify the relevant provider or authority where appropriate.
PhotoCrew is not liable for a third party’s unlawful use of information that a User chose to make public, except to the extent PhotoCrew is legally responsible.
65. Operator reference within these Terms
For ease of reading and to avoid repeating private operator information throughout every provision, these Terms use “PhotoCrew”, “we”, “us” and “our”. The legal operator and address for service are stated in section 66. Users should read section 66 before registering, purchasing or sending a formal legal notice.

Email is the preferred initial contact method.
The address above is provided for business correspondence and service of documents. It must not be used for attendance, personal visits, deliveries unrelated to PhotoCrew, harassment or any other unauthorised purpose.
PhotoCrew does not offer in-person customer service at that address.
A User must not publish, repurpose or misuse operator contact information for intimidation, doxxing, unwanted marketing or purposes unrelated to legitimate legal or business communication.
The operator information in this section may be updated if the business structure, trading status or address changes. Notices sent before an update remain subject to applicable service rules.
67. Email, notifications and delivery failures
PhotoCrew may communicate by email, dashboard notice, website notice, account notification or other contact method supplied by the User.
Users must keep contact details accurate and monitor spam, junk, promotions and filtered folders.
PhotoCrew does not guarantee that an email provider, mobile network, browser or device will deliver or display a message.
Failure to read a validly delivered notice does not necessarily prevent it taking effect.
Users must keep independent records of important messages, invoices, receipts, contracts and cancellation requests.
PhotoCrew is not responsible for loss caused solely by an incorrect email address, full mailbox, spam filter, disabled notification, blocked sender or third-party delivery failure.
68. Data export, backups and preservation of evidence
PhotoCrew is not a permanent archival or evidence-storage service.
Users must download and retain copies of portfolios, contracts, messages, applications, invoices, releases, source files and other important records.
We may delete or overwrite data through ordinary retention, backup, moderation or technical processes.
An export may not contain every technical, security, moderation or third-party record.
Where a dispute is anticipated, Users should preserve their own evidence promptly.
PhotoCrew may preserve data under legal hold and may refuse deletion where law permits or requires retention.
PhotoCrew does not guarantee recovery of deleted or corrupted User Content.
69. International access and local law
PhotoCrew is operated from the United Kingdom but may be accessible elsewhere.
Access from a country does not mean PhotoCrew targets, is licensed in, or complies with every local regulatory regime in that country.
Users are responsible for determining whether access, publication, work, payment and contracting are lawful in their location.
PhotoCrew may restrict countries, regions, IP addresses, payment methods or features.
Users must comply with export controls, sanctions, immigration, tax, privacy, employment and other local laws.
PhotoCrew makes no representation that User Content or services are suitable outside the United Kingdom.
70. Devices, internet access and telecommunications charges
Users provide their own compatible device, browser, software, internet connection and telecommunications service.
Network, roaming, data, SMS, telephone and equipment costs are the User’s responsibility.
PhotoCrew does not guarantee compatibility with obsolete, modified, rooted, jailbroken, unsupported or insecure devices.
Browser extensions, ad blockers, privacy tools, corporate networks and device restrictions may interfere with functionality.
PhotoCrew is not liable for charges or loss caused by a User’s communications provider, device configuration or unauthorised device use, except where law provides otherwise.
71. Accessibility and alternative access
PhotoCrew aims to consider accessibility but does not warrant universal compatibility with every disability, device, browser, assistive technology or individual requirement.
User Content and third-party integrations may not meet the same accessibility standard as functionality controlled directly by PhotoCrew.
Users who encounter a material barrier should contact hello@photocrew.co.uk and provide enough information for investigation.
PhotoCrew may consider a reasonable alternative but cannot promise that every feature can be reproduced in every format or that every third-party limitation can be removed.
Nothing in this section excludes a duty to make reasonable adjustments where applicable.
72. Language, translations and interpretation
The governing version of these Terms is the English version.
Any translation is provided for convenience unless expressly stated otherwise.
Automated translation may be inaccurate.
If a translation conflicts with the English version, the English version prevails to the extent permitted by law.
Users must obtain independent translation assistance where they do not understand the Terms or a User-to-User contract.
73. Feedback, ideas and unsolicited submissions
Users may provide feedback, suggestions, concepts, feature requests or ideas.
Unless separately agreed in writing, feedback is non-confidential and may be used, adapted and implemented by PhotoCrew without payment, attribution or restriction.
Users must not submit confidential information or third-party intellectual property as feedback.
PhotoCrew is not obliged to implement or respond to feedback.
Similar features may be developed independently.
74. Promotions, trials, discounts, referral schemes and credits
Promotions may have eligibility, time, geography, Account, payment and use restrictions.
PhotoCrew may withdraw, correct or refuse a promotion affected by error, fraud, abuse, duplication or technical failure.
Unless stated otherwise, promotions cannot be exchanged for cash, transferred, combined or retrospectively applied.
Trial features may end automatically or convert to paid service only where the checkout and applicable law permit.
Referral benefits may be withheld where Accounts are connected, fake, self-referred, cancelled, refunded or non-compliant.
Credits may expire and are not safeguarded money or stored value unless expressly stated.
Mandatory consumer rights remain unaffected.
75. APIs, integrations, imports and exports
Access to any API, feed, integration, import, export, webhook or automated interface is subject to permission and technical limits.
PhotoCrew may change or withdraw an interface, key, schema, endpoint or quota.
Users are responsible for the security of credentials and legality of imported data.
Users must not use an integration to scrape, reconstruct, republish or create a competing database.
PhotoCrew is not responsible for corruption, duplication, delay or loss caused by an external integration.
Additional developer terms may apply.
76. No continuous monitoring or emergency service
PhotoCrew does not continuously monitor every profile, message, image, video, listing, review or external interaction.
The ability to report content does not guarantee immediate human review.
PhotoCrew is not an emergency service, police service, safeguarding authority, medical service or crisis service.
A person facing immediate danger must contact the appropriate emergency service or authority.
PhotoCrew may use automated detection but automated systems can miss content or create false positives.
Nothing in this section reduces duties imposed directly on PhotoCrew by applicable online-safety or other law.
77. Electronic records and evidence
Platform records, logs, timestamps, Account history, transaction records, consent records, moderation records and electronic communications may be used as evidence to the extent permitted by law.
A timestamp may use Coordinated Universal Time or another system time and may differ from a User’s local time.
Technical records are not guaranteed to be complete or free from error.
PhotoCrew may rely on records supplied by payment, hosting, security and email providers.
Users consent to electronic contracting and electronic notices where legally valid.
An electronic acceptance, checkbox, button, login, continued use or purchase may evidence agreement according to the relevant flow and applicable law.
78. Time limits, notification and mitigation of claims
A User should notify PhotoCrew promptly after becoming aware of a problem so that it can be investigated and, where possible, mitigated.
Delay may prejudice evidence, recovery and the ability to remedy a problem.
Business Users must take reasonable steps to minimise loss.
Subject to any mandatory longer period, a Business User must commence a contractual claim against PhotoCrew within one year after the event giving rise to the claim or, if later, when the Business User ought reasonably to have discovered it.
This contractual time limit does not apply where unlawful, to fraud, or to liability that cannot be limited.
Consumer limitation periods are not reduced below mandatory law.
79. Injunctive and protective relief
Unauthorised scraping, misuse of data, infringement, circumvention, security attacks, disclosure of confidential information and misuse of branding may cause harm that damages alone cannot adequately remedy.
PhotoCrew may seek an injunction, interdict, specific performance, preservation order, disclosure order or other protective relief in any competent jurisdiction.
This right is additional to other remedies.
A Business User agrees that PhotoCrew need not prove special damage where the law does not require it.
80. Final contact and incorporation of policies
Questions, complaints and legal notices relating to these Terms should be sent to hello@photocrew.co.uk and, where formal postal service is required, to the address in section 66.

A summary or FAQ does not override these Terms unless it expressly states that it amends them.
If a policy conflicts with these Terms, the more specific provision applies to its subject matter, subject always to mandatory law.
Schedule 1 — Detailed Acceptable Use and Community Rules
A. General standard
Users must act lawfully, honestly, professionally and with respect for safety, privacy, dignity, equality, intellectual property and the integrity of the Platform.

B. Prohibited identity and account conduct
Users must not:

impersonate another person, company, agency, brand, venue, authority or professional body;
use a false name, stolen identity or unauthorised business identity;
create Accounts for people without authority;
operate undisclosed duplicate Accounts;
transfer or sell an Account;
evade a restriction or suspension;
falsify age, location, qualifications, insurance, awards, clients, availability or experience;
falsely claim to be employed by, endorsed by or affiliated with PhotoCrew.
C. Prohibited content
Users must not publish content that is illegal, infringing, stolen, pirated, defamatory, fraudulent, threatening, hateful, discriminatory, exploitative, intimate without consent, abusive, malicious, deceptive, unsafe, confidential, privacy-invasive, spam, malware, or otherwise contrary to these Terms.

D. Prohibited commercial conduct
Users must not:

advertise a service or role that does not genuinely exist;
use bait pricing or conceal unavoidable charges;
demand unlawful fees from work-seekers;
make false scarcity or urgency claims;
manipulate reviews or rankings;
misuse another User’s personal data;
send unlawful marketing;
evade fees or abuse refunds and chargebacks;
collect deposits for fraudulent projects;
use PhotoCrew to facilitate trafficking, exploitation, tax evasion, money laundering or other crime.
E. Platform integrity
Users must not scrape, crawl, harvest, reverse engineer, interfere with, overload, attack, bypass, copy, reproduce or exploit the Platform without permission. User Content and Platform data must not be used to train AI or machine-learning systems without all necessary permissions and lawful bases.

F. Enforcement
PhotoCrew may apply education, warning, content restriction, removal, de-ranking, loss of features, temporary suspension, permanent termination, preservation of evidence, reporting to authorities and legal action. The response may depend on seriousness, risk, intent, history, impact and legal obligations.

Schedule 2 — Detailed Review and Rating Policy
A review must relate to a genuine experience or interaction.
The reviewer must be able to explain the basis of the review.
A review must not be submitted by the reviewed person, a controlled Account, employee, family member, close associate or paid agent in a misleading manner.
Incentivised reviews must be genuine and clearly disclosed where permitted.
Negative reviews must not be suppressed merely because they are negative.
Positive and negative reviews must be treated according to consistent moderation criteria.
PhotoCrew may analyse Account links, timing, IP, device, language, payment, communication, interaction and other signals to detect manipulation.
PhotoCrew may request contracts, messages, invoices, dates or other evidence, but Users should redact unnecessary sensitive information.
A failure to provide evidence may be considered but does not automatically prove falsity.
A review may be temporarily restricted during investigation.
PhotoCrew may remove a review that is fake, concealed-incentivised, irrelevant, abusive, defamatory, privacy-invasive, threatening, extortionate, discriminatory, duplicated, coordinated or otherwise unlawful.
PhotoCrew may label a review or rating where context is necessary.
Star ratings may exclude removed, suspicious or ineligible reviews.
PhotoCrew does not guarantee that every fake review will be prevented or detected.
A person disputing factual allegations should provide a precise explanation and evidence.
PhotoCrew does not act as a court and may require parties to seek legal resolution.
Repeated manipulation may result in permanent Account termination.
Review records may be retained for fraud prevention, legal claims and compliance.
Schedule 3 — Search, Ranking, Recommendation, Featured and Boost Policy
Search may consider query relevance, category, service, location, distance, availability, profile completeness, content quality, recency, activity, reviews, verification, Account standing, response signals, engagement, Paid Plan, Featured or Boost status, safety, fraud and technical factors.
No single factor guarantees position.
Weighting may differ by search, page, device, geography, inventory, experiment and User context.
PhotoCrew may rotate results to improve diversity or prevent dominance.
New, inactive, incomplete, duplicated, restricted or suspicious content may receive lower visibility.
Paid promotion may increase eligibility, placement or exposure but does not guarantee a particular rank, duration of display, number of impressions or commercial result.
A Boost may be affected by competition, search demand, category inventory, technical outages, consent settings and moderation.
Rankings may change without notice.
Analytics are estimates and may be filtered for bots, duplicate views, internal traffic and suspicious activity.
Business Users may complain about a material restriction, suspension or termination through hello@photocrew.co.uk.
PhotoCrew may provide reasons where required by law, but may withhold detail to protect security, confidential information, investigations and anti-fraud systems.
Where the Platform-to-Business rules apply, material changes to Business User terms will be notified with the legally required notice period unless an exception applies.
Schedule 4 — Consumer Cancellation Form and Immediate Performance
A qualifying Consumer may communicate cancellation by any clear statement. The following optional form may be emailed to hello@photocrew.co.uk:

Where a Consumer asks PhotoCrew to begin a service during a statutory cancellation period, PhotoCrew may ask the Consumer to confirm:

> “I expressly request that PhotoCrew begins supplying the service during the 14-day cancellation period. I understand that if I cancel after supply has begun, I may have to pay a proportionate amount for the service supplied, where the law permits.”

Where the legal classification is digital content and the legal requirements apply, a separate express acknowledgement may be requested before immediate supply.

Schedule 5 — Copyright, Privacy and Other Rights Complaints
A complaint should include:

complainant identity and contact details;
authority to act where representing another person;
exact URL or identifier;
identification of the protected work, person, information or right;
explanation of the alleged infringement or unlawfulness;
evidence of ownership, consent, restriction or other legal basis;
a good-faith statement;
confirmation that information is accurate.
PhotoCrew may request clarification, preserve records, restrict content, notify the publishing User, permit a response, restore content, reject unsupported notices or refer parties to a court. Removal is not an admission of liability or a final determination of rights. False or abusive notices may lead to enforcement.

Schedule 6 — User-to-User Project Checklist
PhotoCrew strongly recommends that Users record the following in writing before work begins:

legal names and addresses;
authority of signatories;
project description;
dates, times and locations;
crew and subcontractors;
deliverables and technical specifications;
approvals and revision limits;
fee, deposit, expenses, overtime and VAT;
payment milestones and late payment;
cancellation and postponement;
weather, illness and force majeure;
copyright and licensing;
portfolio permission;
confidentiality and embargo;
model, location, property, performer and music releases;
data protection;
insurance;
health and safety;
equipment responsibility;
complaint and dispute procedure.
This checklist is general information, not a contract or legal advice. PhotoCrew does not guarantee that it is complete for a particular project.

Schedule 7 — Gigs, Jobs and Applications Rules
Listings must be genuine, current, accurate and lawful.
Publishers must identify the nature of the opportunity honestly.
Compensation, unpaid status, expenses and material conditions must not be misleading.
Publishers must not discriminate unlawfully.
Applicants must provide accurate information and must not misrepresent experience, identity or eligibility.
PhotoCrew does not guarantee applications, interviews, responses, hires or work.
PhotoCrew does not guarantee that an advertiser will pay, respond or proceed.
Users must conduct right-to-work, identity, qualification and other checks where legally responsible.
PhotoCrew may remove expired, duplicated, suspicious, discriminatory, unlawful or misleading listings.
Application data must be used only for lawful recruitment or project purposes and retained no longer than necessary.
A listing publisher must not add applicants to marketing lists without a lawful basis.
The legal status of an arrangement is determined by actual facts and law, not the label selected on PhotoCrew.
Schedule 8 — Paid Plans, Add-ons, Credits, Featured Placement and Boosts
The specific product page and checkout define the purchased feature, duration, price and included limits.
Unless stated otherwise, subscriptions are paid in advance and renew automatically until cancelled.
Cancellation normally prevents the next renewal and does not automatically refund an already-started period.
Mandatory Consumer cancellation and quality rights remain unaffected.
Add-ons and credits may expire.
Deleting a listing does not necessarily restore an included slot.
A downgrade may hide or restrict content exceeding the lower plan limit without immediately deleting it.
Existing content may remain stored while only the permitted amount is publicly displayed.
A Paid Plan does not guarantee search position, traffic, contacts, bookings or revenue.
A badge represents plan status only unless expressly described as verification.
Payment failure may cause retry, grace period, downgrade, suspension or termination.
PhotoCrew may correct obvious pricing errors.
Taxes may be added if PhotoCrew’s tax status changes.
Promotions may be restricted to eligible Accounts and cannot be abused through duplicate Accounts.
A chargeback may result in restriction while the matter is investigated.
PhotoCrew may alter future plan features and prices after appropriate notice, subject to mandatory law and any specific purchased commitment.
Schedule 9 — Safety and Illegal Content Reporting Procedure
Reports may be sent through an available reporting tool or to hello@photocrew.co.uk and should contain the exact URL, Account, content, reason, risk, date and evidence.

PhotoCrew may prioritise reports involving child sexual exploitation or abuse, threats, violence, terrorism, fraud, intimate-image abuse, trafficking, stalking, harassment, illegal discrimination, intellectual-property infringement and urgent safety risks.

PhotoCrew may investigate, request information, preserve evidence, restrict content, suspend Accounts, block contact, report to authorities or take no action where the report is unsupported or outside scope. PhotoCrew does not guarantee immediate response or a particular outcome. Immediate danger must be reported to emergency services.

Schedule 10 — Security and Responsible Disclosure
A security report should be sent privately to hello@photocrew.co.uk and include enough information to reproduce the issue.

A reporter must not:

access unnecessary personal data;
alter or delete data;
disrupt service;
demand payment through threats;
publish details before a reasonable remediation opportunity;
use social engineering, phishing or physical attacks;
retain copied data.
PhotoCrew does not operate a guaranteed bug-bounty programme unless expressly announced. Submission does not create a right to payment, employment, immunity or public credit.

Schedule 11 — Business User Indemnity Detail
Without limiting section 36, a Business User’s indemnity may include reasonable losses arising from claims concerning:

copyright, trade marks, privacy, confidentiality and image rights;
portfolio and advertising content;
services, deliverables and non-performance;
injury, property and equipment damage;
employment, worker status, wages, tax and right to work;
discriminatory or unlawful listings;
data protection and unlawful marketing;
fake reviews and misleading claims;
fraud, chargebacks and non-payment;
breach of licence, release, venue or client restrictions;
regulatory investigation caused by the Business User’s acts;
enforcement of these Terms.
The indemnified person must take reasonable steps to mitigate loss. PhotoCrew may control the defence or settlement where its interests are affected, and the Business User must provide reasonable cooperation. No settlement admitting PhotoCrew liability may be made without consent.

Schedule 12 — Platform Risk Acknowledgement
By using PhotoCrew, the User acknowledges, to the fullest extent permitted by law, that:

online identities can be false or compromised;
portfolio content can be stolen or misleading;
reviews can be inaccurate despite controls;
communications can contain scams or malware;
public information can be copied or scraped;
search and analytics are imperfect;
third-party providers can fail;
meetings and projects involve physical and commercial risk;
contracts and payments between Users are outside PhotoCrew’s direct control;
no Platform can prevent every unlawful act;
Paid Features do not guarantee results;
Users must undertake independent due diligence and retain appropriate contracts, evidence, backups and insurance.
This acknowledgement does not waive rights that cannot lawfully be waived.
